Temporary Restraining Divorce Attorney GA

If the spouses are not able to resolve their issues by mutual agreement, questions of child custody, visitation and attorney’s fees must be determined by the judge not a jury. But if the judge or, if one of the parties requests, a jury, will resolve the financial issues of the marriage such as division of property, division of debts, alimony and child support. Both spouses may introduce evidence by their own testimony and may also summon other witnesses to the final trial. The decision returned by a judge or jury is written into a court order that is binding upon both parties. At any temporary hearing, only the judge can make the decisions.

A temporary restraining order is simply a way for preserving the status quo before the temporary orders hearing. It prevents the parties from doing such things as cleaning out bank accounts, removing parties from accounts, selling assets, and removing the children from school or taking the children and running. Only one party needs to be present in the courtroom when a temporary restraining order is issued. After the temporary restraining order is issued, there is a hearing a couple weeks later when the parties must explain to the court why the order should be made permanent or cancelled. A restraining order can remain in effect for a period of time, even several years.
